A disabled man from Portsmouth has been banned from using his mobility scooter for 12 months after being caught drink driving.
Kenneth Fitzpatrick was seen driving on a pavement with a passenger clinging to the front of his scooter when police stopped him. It soon became apparent that he had been drinking, and when breathalysed it showed him to be nearly 2 times over the legal limit.
This is not the first time Mr Fitzpatrick has got into trouble on his mobility scooter. In December he was given a conditional discharge after being caught travelling at speed. When stopped he shouted and swore at the police officers resulting in him being charged with a public order offence.
Swain & Co.’s specialist motoring offence representation solicitors say that Mr Fitzpatrick had been warned about his behaviour and seems not to have taken heed to this warning. Now Mr Fitzpatrick has a driving disqualification meaning that he cannot use his mobility scooter. This is going to have a huge impact on him as he is a disabled man.
We are pleased that the Mr Fitzpatrick’s disability has been taken into account when sentencing, as the driving ban period has been reduced from the standard 18 months to 12 due to his medical situation, and the fine is in line with his limited disability income, and will be deducted from his benefits.
This really is the best outcome for Mr Fitzpatrick as it was his second offence.
